THE STOPPING-UP OF HIGHWAYS (LONDON BOROUGH OF ENFIELD (ENFIELD TOWN)) (NO 1) ORDER 2003
The Mayor and Burgesses of the London Borough of Enfield hereby
give notice that they have made an Order under section 247 of the
Town and Country Planning Act 1990 (as amended by Schedule 22 to the
Greater London Authority Act 1999) (“the Act”) entitled “The
Stopping-Up of Highways (London Borough of Enfield (Enfield Town))
(No 1) Order 2003” to authorise the stopping-up of those sections of
the highways in Enfield Town in the London Borough of Enfield known
as Sydney Road (the section between The Town and Cecil Road) and
Part of Public Footpath Number 75 from London Road to Chalkwell Park
Avenue as the same are more particularly defined in the Schedule
hereto and shown on Plan No WX00672/067/B attached to the Order
(“the Plan”).
Stopping-up will be authorised only in order to enable development
to be carried out in accordance with the planning permission granted
under Part III of the Act to John Laing Property Limited through
their Agents, Montagu Evans, of Premier House, 44-48 Dover Street,
London W1X 4JX, by the London Borough of Enfield on 3 May 2001 under
Ref TP/00/0977.
No part of the highway shown on the Plan by diagonal hatching and
known as Sydney Road (the section between The Town and Cecil Road)
may be stopped up pursuant to this Order until the new highway,
shown by stippled shading on the Plan, has been completed to the
reasonable satisfaction of the London Borough of Enfield and is open
for use by the general public.
Copies of the Order and the Plan may be inspected at all reasonable
hours at the offices of the London Borough of Enfield at B Block
Reception, Civic Centre, Silver Street, Enfield, Middlesex EN1 3XA,
and may be obtained, free of charge, from that address quoting Ref
DA/LEGAL.
Any person aggrieved by the Order and desiring to question the
validity thereof or any provision contained therein on the ground
that it is not within the powers of the Act or that any requirement
of the Act or of any regulation made thereunder has not been
complied with in relation to the Order may within 6 weeks of the
date of this notice apply to the High Court for the suspension or
quashing of the Order or any provision contained therein.
